09-21-70 City Council Minutesd6 REGULAR MEETING of the VILLAGE COUNCIL September 21, 1970 Pursuant to due call and notice thereof, a regular meeting of the Village Council of the Village of Golden Valley, Hennepin County, Minnesota, was held at 7800 Golden Valley Road in said Village on September 21, 1970, at 7:30 o'clock P.M. The following members were present: Bies, Jensen, Paulson, Stockman, and Teresi; and the following were absent: None. Present were Assistant Village Manager, John Murphy; Village Attorney, Robert M. Skare; Village Engineer, Lowell Odland; Village Clerk, Helen Penniman. Public Hearing - Plat, Brogger's Addition: The Village Clerk presented an affidavit of publication in the official newspaper of the Notice of Public Hearing as described in said affidavit. Said affidavit was examined, approved and ordered filed in the Clerk's office. The Mayor announced that this was the time and place for the public hear- ing above referred to and all persons present to do so were afforded oppor- tunity to express their views thereon. Proponent requested the Public Hearing be continued. MOVED by Jensen seconded by Stockman carried to continue the public hear- ing on the plat of Brogger's Addition. Public Hearing - Zoning, Open Development to Residential, Neil M. Brogger: The Village Clerk presented an affidavit of publication in the official newspaper of the Notice of Public Hearing as described in said affidavit. Said affidavit was examined, approved and ordered filed in the Clerk's office. The Mayor announced that this was the time and place for the public hearing above referred to and all persons present to do so were afforded opportun- ity to express their views thereon. Proponent requested Multiple Dwelling zoning district instead of Resident- ial District. MOVED by Stockman seconded by Jensen carried to continue the public hearing and refer the request for Multiple Dwelling zoning district to the Planning Commission. Public Hearing: Plat, Olympia Oaks Second Addition: The Village Attorney reviewed the legal requirements for final approval of Regular Meeting of the Village Council, September 21, 1970 the plat of Olympia Oaks Second Addition. The Mayor closed the public hearing. Member Jensen introduced the following resolution and MOVED its adoption: "RESOLUTION" (Acceptance of Plat - Olympia Oaks Second Addition) The motion for the adoption of the foregoing resolution was seconded by Member Paulson, and upon vote being taken thereon, the following voted in favor thereof: Bies, Jensen, Paulson, Stockman, and Teresi; and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted, signed by the Mayor and his signature attested by the Village Clerk. Continued Public Hearing - appeal from BZA - 1530 Pennsylvania Ave. North: Mr. Nick Loscheider was present to request an appeal from the Board of Zon- ing Appeals for 1530 Pennsylvania Avenue North. The Mayor closed the public hearing. Member Stockman requested a statement from Mr. Loscheider that he realized his responsibility as a contractor in Golden Valley and will cooperate with the Village Staff in the future. Mr. Loscheider so stated and said he would abide by the Village Ordinances. MOVED by Paulson seconded by Bies carried to grant the appeal from the Board of Zoning Appeals and waive the ordinance of sideyard setback for the prop- erty at 1530 Pennsylvania Avenue North for the 2.7' violation. Members Stockman and Teresi voted "No." Second Reading - Platting Fees Ordinance: MOVED by Stockman seconded by Paulson carried to give a second reading to an ordinance entitled: "AN ORDINANCE AMENDING THE VILLAGE CODE" (Filing Fees - Re: Plats) MOVED by Stockman seconded by Bies carried to approve the ordinance herein quoted by title on its second reading and to order publication thereof. See Ordinance Book page. Ordinance - Phosphate Disclosure: MOVED by Stockman seconded by Bies carried to defer pending hearing from local grocers regarding the proposed ordinance. Regular Meeting of the Village Council, September 21, 1970 Dr. Ronald Berry, 924 Adeline Lane; Re: Sweeney Lake Storm Water: All present agreed to add the above item to the agenda. Dr. Berry introduced Dr. Milton Alter, 1820 Major Drive, who stated that Dr. Shapiro would need a longer time for study of Sweeney Lake than six months since the coming months would be winter time. Dr. Alter requests a clearer directive from the Council, and requested that members of the Sweeney Association serve on the committee studying the biological sur- vey of Sweeney Lake. MOVED by Stockman seconded by Paulson carried that the village contact Dr. Shapiro regarding the proposed biological study of Sweeney Lake and notify members of the Sweeney Lake Association of progress. Golden Valley School District #275, Proposed Building Plan Presentation: Mr. Don Palmer, School Board Member of District #275, presented proposed plans for additions, remodeling and new construction for School District #275. They expect bids to be ready November 17, 1970, ground breaking December 1, 1970 and completion approximately April, 1972, with a result - 11.9% increase in school tax making 60.5% of the tax levy in 1971. The new construction will cost approximately $26.00 a sq. foot and remodel- ing $16.00 a square foot. State Highway Department - Signal Agreement, T.H. #55 at Glenwood Parkway, Douglas Drive & Winnetka Avenue North: Mr. Lasky, State Highway Department, presented a proposed signal agreement for traffic signalization on T. H. #55 at Glenwood Parkway, Douglas Drive and Winnetka Avenue North. Present signals will be removed and replaced with larger and new signals with 400 Watt mercury lighting at the inter- sections. The cost will be shared 25% Village, 25% Hennepin County and 50% State Highway Department. MOVED by Jensen seconded by Paulson carried to approve the signal agree- ment between the State Highway Department, Hennepin County and Golden Valley for T.H. #55 at Glenwood Parkway, Douglas Drive and Winnetka Ave- nue North, subject to the deletion of the paragraph regarding obstruction on trunk highway in general and that same apply only to T. H. #55. League of Women Voters - Re: 1971 Budget: The Assistant Village Manager presented a letter dated September 17, 1970, from The League of Women Voters regarding a two mill levy in the Village budget to carry out the Park Department's long range plan for park devel- opment. MOVED by Jensen seconded by Bies carried to receive and file the request and refer same to the budget committee. Request to Fly Pennants, Spur Station, 7550 Olson Highwa A request to fly pennants for the week of Stptember 23rd thru the 30th at the Spur Station at 7550 Olson Highway was presented. MOVED by Stockman seconded by Bies carried to approve the request to fly pen- nants the week of September 23rd thru the 30th at the Spur Station at 7550 Olson Highway. Reauest for Temporary Signs - Chrvsler Citv. 6800 Wayzata Boulevard: All present agreed to add the above item to the agenda. Mr. Robins requested eight temporary signs regarding Chrysler City Service Department for thirty days. MOVED by Bies seconded by Stockman carried to deny the request and refer the matter to the Building Board of Review. Regular Meeting of the Village Council, September 21, 1970 Request for Transfer of $1,800.00 to Park Shop Fund: The Assistant Village Manager requested the transfer of $1,800.00 to the Park Shop Fund. MOVED by Jensen seconded by Paulson carried to approve the transfer of $1,800.00 to the Park Shop fund. Guidelines for "Ride -Along" Program for Commission & Board Members: The Village Attorney presented a memorandum and cover letter dated Septem- ber 17, 1970, regarding the legal questions involved and an inquiry into the village insurance coverage, as it might relate to this matter. Mr. Graves, Human Rights Director, presented suggested guidelines from the Police Department and himself, dated September 18, 1970. MOVED by Stockman seconded by Paulson carried to accept the program with the proposed guideline subject to approval by the Human Rights Commission and securing insurance coverage. Request for Public Hearing - T.H. #100 & CSAH #66: The Village Engineer presented the request for a public hearing on the proposed plans for the interchange at T.H. #100 and CSAH #66. MOVED by Paulson seconded by Jensen carried to call a public hearing to review the proposed plans for the interchange at T.H. #100 and CSAH #66 on November 2, 1970. Application for Authoritv to Disnose of Records: The Village Clerk presented an Application for Authority to Dispose of Records to the Minnesota State Archives Commission under M.S. 138.17 relating to the destruction of records. MOVED by Jensen seconded by Bies carried to approve the Application for Authority to Dispose of Records. Waiver of Platting Ordinance - 6845 Harold Avenue,_ 6900 Glenwood_ Avenue; Lot Division: The Assistant Village Manager presented the request for waiver of the Platting Ordinance at 6845 Harold Avenue and 6800 Glenwood Avenue for division of the following property: 6845 Harold Avenue: Lot 5, Block 4, Windsor Woods ME Regular Meeting of the Village Council, September 21, 1970 6900 Glenwood Avenue: That part of Lot 4, Block 1, Fahrendorff Addition lying south- erly of Windsor Woods. Appointment of Representative from Chamber of Commerce to Police Community Relations Committee: All present agreed to add the above item to the agenda. MOVED by Bies seconded by Jensen carried to appoint Donald Byerly to the Police Community Relations Committee as the representative from the Golden Valley Chamber of Commerce.
