02-22-77 City Council MinutesREGULAR MEETING of the City Council February 22, 1977 Pursuant to due call and notice thereof, a regular meeting of the Council of the City of Golden Valley, Hennepin County, Minnesota was held at 7800 Golden Valley Road is said City on February 22, 1977 at 6:30 p.m. The following members were present: Anderson, Johnson, Swartz and Thorsen. Also present were Assistant City Manager Jeff Sweet, City Attorney Robert M. Skare, City Engineer Lowell E. Odland and City Clerk Mary H. Marske. Due to the absence of the Mayor, the Mayor Pro -tem called the meeting to order. Approval of Minutes - February 7, 1977 MOVED by Swartz, seconded by Thorsen and carried to approve the minutes of the regular meeting of February 7, 1977 as corrected. Approval of Verified Accounts MOVED by Swartz, seconded by Johnson and carried to approve payment of the verified accounts as submitted on the prelist. Claims - Edward Wydo & G. C. Strasburgvs. the City of Golden Valley MOVED by Johnson, seconded by Thorsen and carried to receive and file the claims against the city from Edward Wydo and G. C. Strasburg and direct the City Clerk to forward said claims to the insurance carrier. Call Public Hearing - P.U.D. #16A - Concept Plan - 5916 Glenwood. MOVED by Thorsen, seconded by Swartz and carried to call a public hearing for the purpose of reviewing the concept plat of P.U.D. #16A for March 21, 1977 at 7:30 p.m. D. Magnuson - Re: Pedestrian Facilities on Golden Valley Road MOVED by Thorsen, seconded by Johnson and carried to receive and file the communication from Darlene Magnuson and request the Mayor to respond to Ms, Magnuson conveying the information on petitions for street lights and the possibility of discussing the matter of signs with the Safety Council. MOVED by Thorsen, seconded by Johnson and carried to refer the letter re- ceived from Darlene Magnuson to the Safety Council for their comments. Dr. R. Fredsall - Re: Request to Extend 6 Month Limit for Plat Filing MOVED by Johnson, seconded by Thorsen and carried to approve the request for a six month extension on the requirements for plat filing as requested by Dr. R. Fredsall in his letter of February 10, 1977. City of Minneapolis - Re: Water Rate Change MOVED by Johnson, seconded by Thorsen and carried to receive and file the letter from the City of Minneapolis regarding the increase in the water charge to Golden Valley. R. Haskvitz Re: Youth Committee MOVED by Thorsen, seconded by Johnson and carried to receive and file the communication from Ron Haskvitz, chairman of the Human Rights Commission in regard to the Youth Committee. State Hi&Lway Commissioner - Re: Transportation Plan MOVED by Johnson, seconded by Thorsen and carried to receive and file the letter from the State Highway Commissioner in regard to the Transportation Plan. MOVED by Thorsen, seconded by Johnsonand carried to place this item on the agenda of March 21, 1977 and any Councilmembers that have items to add to the list of things to be discussed will contact the City Clerk before the meeting. Board & Commission Appointments and Confirmations MOVED by Swartz, seconded by Thorsen and carried to re -appoint Mike Sell, Mahlon Swedberg, Glen Christiansen and Walter Kost for another one year to serve on the Board of Zoning Appeals. 20 Regular Meeting of the City Council, February 22, 1977 MOVED by Thorsen, seconded by Johnson and carried to re -appoint Frank Hetman for another term expiring March 1, 1980, on the Building Board of Review. MOVED by Johnson, seconded by Thorsen and carried to confirm the Mayor's appointment of Ann Gallagher to the Civil Service Commission for a three year term. MOVED by Johnson, seconded by Swartz and carried to reappoint Albert DeSautels for a three year term and appoint Perry Finney for a three year term on the Environmental Commission. MOVED by Johnson, seconded by Thorsen and carried to appoint Carl Elkins to a three year term on the Housing and Community Development Commission. MOVED by Swartz, seconded by Thorsen and carried to re -appoint for three year terms to the Human Rights Commission the following persons: Arlene Dockman, Matthew Johnson and Esther Neuwirth, and appoint Louis Simon for a three year term, Jay Pearson for a two year term and Max Goldberg for a one year term. MOVED by Johnson, seconded by Thorsen and carried to re -appoint for a three year term to the Park and Recreation Commission the following per- sons: Ron Hammer and Rhoda Jaffe and appoint Sue Eastes to a three year term, Jim Haglund to a two year term and Robert White to a one year term. MOVED by Thorsen, seconded by Johnson and carried to re -appoint G. Wm. Forster and Jody Sehlin for three year terms on the Planning Commission and appoint Herb Polachek.to a three year term. MOVED by Swartz, seconded by Johnson and carried to re -appoint Marilynn Huret to another three year term on the Safety Council. Joint Meeting, with Commission and Council MOVED by Swartz, seconded by Johnson and carried to set March 30, 1977 for a dinner meeting with the members of the city's boards and commissions at Brookview at 6:30 p.m. 77 SS 4 - Westwood Drive South The City Clerk presented an affidavit of publication in the official news- paper of the notice of public hearing on said proposed public improvements. Said affidavit was then examined, approved and ordered filed in the office of the City Clerk. The City Engineer briefly backgrounded the storm sewer project on Westwood Drive, The Mayor Pro -tem announced the meeting was open for public hearing on said public improvements and persons present to do so were afforded the opportun- ity to express their views thereon. Ken Gaines, 120 Maddus Lane asked who requested the public improvement. 91W Regular Meeting of the Council, February 22, 1977 L. M. Anderegg, 117 Westwood Drive asked if there were any alternative method of drainage possible. L. W. Wente, 401 S. Westwood Drive questioned the construction of a storm sewer to drain low land that has been developed under poor circumstances. R. J. Fredsall, 520 Westwood Drive explained the reason for the request of drainage of his proposed plat. Joe Johnson, 108 Maddus Lane stated he saw no need for drainage along Maddus Lane. L. W. Heinemann, 116 Maddus Lane stated a concern that the water run-off be preserved and the present drain tile be left intact. M. H. Mattison, 517 Westwood Drive asked if the catch basins were rebuilt would they adequately handle the run off in the area. A. R. Kephart, 4505 Glenwood stated that no problem exists regarding drain- age on Westwood Drive near her property. L. M. Anderegg, 117 Westwood Drive stated that it had not been proven that more than one property will benefit from the construction of the storm sewer. M. H. Mattison, 517 Westwood Drive asked if the cost of re -surfacing the streets was included in the estimated project cost. Elvera Springer, 109 Maddus Lane felt that a majority of the area residents see no need for construction of a storm sewer, and she also asked where a storm sewer line would be placed. K. J. Anderson, 104 Maddus Lane stated that two items were to be determined (1) is there a problem of water on Maddus Land and Westwood Drive and (2) if there is a problem would the reconstruction of Maddus Lane solve that problem. The Mayor Pro -tem then closed the public hearing. MOVED by Swartz, seconded by Johnson and carried to continue discussion of this issue to the council meeting of March 21, 1977 and request the staff to pursue the possibility and problems involved in acquiring ponding area and easements as an alternative solution, Waiver of Platt - Griswold Coffee Company - 8320-8360 10th Avenue North The City Engineer presented the staff report on the waiver and the findings of the Planning Commission in regard to the waiver. Mr. Bob Steiner, representing the proponent formally requested the granting of the waiver. MOVED by Thorsen, seconded by Johnson and carried to approve the waiver of 22 Regular Meeting of the City Council, February 22, 1977 the platting ordinance as requested and assign the following legal descrip— tions to the newly divided parcels: Tract A - 8360 10th Avenue North - The West 171.47 feet of Lot 1, Busch's Golden Valley Acres, Hennepin County, Minn- esota as measured along the South line of said Lot 1. Tract B - 8320 10th Avenue North - All of Lot 1, Busch's Golden Valley Acres, Hennepin County, Minnesota except the West 171.47 feet thereof as measured along the South line of said Lot 1. Bid Award - Lakeview Heights Recreation Building ,from 1/3/77) MOVED by Swartz, seconded by Thorsen and carried to defer the award of the contract for the construction of the recreation building at Lakeview Heights Park to April 18, 1977 as requested by the Assistant City Manager. Suburban Nursing Service - Offer of Optional Services The Council briefly reviewed the memo from the Public Health Sanitarian Tom Heenan and the communication from the Suburban Nursing Service. MOVED by Swartz, seconded by Thorsen and carried to request the staff to advise the Suburban Public Health Nursing Service the Golden Valley is not presently interested in the offer of additional service at this time. Ordinance Amendment - Water Rate Change MOVED by Swartz, seconded by Johnson and carried to bring on for a first reading an ordinance amendment entitled: AN ORDINANCE AMENDING THE CITY CODE (Amending Schedule of Rate Charges to Water Users) MOVED by Swartz, seconded by Johnson and carried to approve the ordinance herein quoted by title on its first reading. Upon roll call vote being taken thereon, the members were recorded as voting as follows: Anderson - Yes Swartz - Yes Johnson - Yes Thorsen - Yes Call Public Hearing - Annual Board of Review (Assessments) - 5/24/77 MOVED by Johnson, seconded by Swartz and carried to call a Public Hearing for the purpose of the Annual Board of Review for property value assess- ments for May 24, 1977 at 7:30 a.m. Legislative Report - G. Johnson Councilmember Johnson briefly reported on the legislative meeting she attend- ed sponsored by the League of Minnesota Cities and the items discussed at the meeting. 1 1 Regular Meeting of the City Council, February 22, 1977 Agenda for Meeting with Planning Commission - 2/28/77 The Council briefly discussed the matter to be taken up with the Planning Commission when they meet jointly on February 28, 1977. Main topics of discussion will be open space and double bungalows.
