04-14-80 Special MeetingSpecial Meeting Of The City Council April 14, 1980 Pursuant to due call and notice thereof, a special meeting of the City Council of the City of Golden Valley, Hennepin County, Minnesota was held at 7800 Golden Valley Road in said City on April 14, 1980 at 7:20 P.M. The following members were present: Anderson, Johnson, Mitchell, Stockman and Thorsen, and City Manager, Jeff Sweet. Order of the City to Reinertson & Associates Re Removal of Hazardous Buildings MOVED by Anderson, seconded by Johnson and carried to approve an order declaring the Reinertson & Associates, Incorporated Building at 5800 Duluth Street to be a hazardous building as set forth in the form attached hereto and made a part hereof, listed as Exhibit A. Adjourn to April 15, 1980 MOVED by Johnson, seconded by Mitchell and carried to adjourn at 7:25 P.M. to Tuesday, April 15, 1980, 9:00 P.M. to set a date for the sale of bonds for Valley Square. ATTEST: SEC ETARY �1 ROSEMARY THOkSEN, YAYOR EXHIBIT "A" ORDER OF THE CITY COUNCIL OF THE CITY OF GOLDEN VALLEY, HENNEPIN COUNTY, MINNESOTA TO: Reinertson & Associates, Incorporated, a Minnesota Corporation 5800 Duluth Street Golden Valley, Minnesota Legal Desription: Tract A except that part thereof embraced in the plat of Hipp's Graceful Plaza Addition, Registered Land Survey No. 331, Files of Registrar of Titles, County of Hennepin FROM: CITY COUNCIL, CITY OF GOLDEN VALLEY, HENNEPIN COUNTY, MINNESOTA You and each of you are hereby ordered pursuant to the provisions of Minnesota Statutes 463.15 to 463.26, inclusive, to take the following action with respect to the above described property, upon which the City Council of the City of Golden Valley has determined there exists a hazardous building within the meaning of the afore- said Minnesota Statutes: 1. Remove the building/dwelling structure now located upon the above described premises. 2. Fill to grade and cover any excavation remaining after the removal hereinabove ordered in Paragraph 1. 3. Cut and seal the sanitary sewer line leading from the premises to the municipal lateral sewer pipe at the point of the connection of the house line with the lateral in the City street right-of-way. 4. Cut and seal the water line leading from the premises to the municipal lateral water line at the point of connection of the house with the lateral in the City street right-of-way. 5. Cut and seal the gas line, if any, leading from the premises. It is hereby further ordered by the City Council of the City of Golden Valley that you shall have 30 days from the date of service of this Order upon you within which to comply with the terms of this Order and that you are hereby notified that a Motion for Summary J-odgment and enforcement of this Order will be made to the District Court of Hennepin County, State of Minnesota, if the action ordered hereby is not taken prior to the aforesaid compliance date, or unless an answer to this Order is served upon the City of Golden Valley within twenty (20) days from the date of the service of this Order upon you, in the manner of such Answer as is provided in Minnesota Statutes 463.18. The foregoing Order is based upon the finding by the City (b) That the basement of said structure is partially open and exposed with the result that children and other persons are subject to the hazards of falling into the same and in other respects being injured thereby. (c) That the building is a haven for rodents, constituting the same menace to public health. (d) That because of the aforesaid and other conditions recited above, the building has depreciated to the point where the cost of repairing the same would exceed the reasonable value thereof and the building should therefore be razed or removed. 1 Council of the City of Golden Valley that the following grounds exist therefor: (a) That the floor joists and subflooring of said building have deteriorated to the point where the covering over the dwelling has become an extreme hazard to children and other persons living in the area. (b) That the basement of said structure is partially open and exposed with the result that children and other persons are subject to the hazards of falling into the same and in other respects being injured thereby. (c) That the building is a haven for rodents, constituting the same menace to public health.
