12-21-82 City Council MinutesRegular Meeting of the City Council December 21, 1982 Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Golden Valley, Hennepin County, Minnesota was held at 7800 Golden Valley Road in said City on December 21, 1982 at 6:30 PM. The following members were present: Anderson, Johnson, Mitchell, Stockman and Thorsen. Also present were: City Manager, Jeff Sweet; City Engineer, Lowell Odland; Assistant City Attorney, Allen Barnard; and Deputy City Clerk, Judy Nally. Approval of Minutes - December 7, 1982 MOVED by Anderson, seconded by Mitchell and motion carried unanimously to approve the minutes of the City Council meeting of December 7, 1982, as amended: Page 211: Fire Department Budget Adjustment - add "for the 1983 Budget" after requests in the second line and "1983" before Balance in the third line. Approval of Agenda MOVED by Anderson, seconded by Mitchell and motion carried unanimously to approve the agenda of December 21, 1982, as amended: Removal from Consent Agenda of Item 5F: Ratification of Emergency Purchase of Rebuilt Engine for Fire Truck Addition of Item 5G: Change January Council/Manager and Housing and Redevelopment Authority Meeting Date Approval of Consent Agenda MOVED by Stockman, seconded by Johnson and motion carried unanimously to approve the items on the consent agenda, indicated by an asterisk (*), except Item 5F. *Bills and Claims MOVED by Stockman, seconded by Johnson and motion carried unanimously to authorize payment of the bills as submitted. *Claim from Mark Labine for Mark Hurd Aerial MOVED by Stockman, seconded by Johnson and motion carried unanimously to refer the claim from Mark Labine for Mark Hurd Aerial to the City Attorney and the insurance company. *Licenses MOVED by Stockman, seconded by Johnson and motion carried unanimously to authorize the issuance of licenses #7906 to #7939, and heating licenses #5414 to #5415. Public Hearing - First Reading - Rezoning to R-2 - 5525-5527 and 5535-5537 Lindsav Street MOVED by Mitchell, seconded by Anderson and motion carried unanimously to bring on the table for first reading the ordinance amendment herein entitled: AN ORDINANCE AMENDING THE ZONING CODE (Two -Family R-2 Residential Zoning District) 5525-5527 and 5535-5537 Lindsay Street Gary Prazak - Planning Commissioner - stated that the Planning Commission recommended approval of the request for rezoning in keeping with anticipated double bungalow development in the area and answered questions from the Council. The Mayor opened the meeting for public input and persons present to do so were afforded the opportunity to express their views thereon. MOVED by Johnson, seconded by Mitchell and motion carried unanimously to approve on second reading the ordinance amendment herein quoted by title, subject to the following conditions: 21, Regular Meeting of the City Council December 21, 1982 Public Hearing - Second Reading - Conditional Use Permit - 600 Decatur Avenue North - Continued 1. Restriction of building uses other than the tire service and automobile repair service to permitted uses within the Commercial Zoning District Section of the City Zoning Ordinance and to uses which do not conflict with the space and parking requirements for the tire service and automobile repair service. 2. Building Board of Review approval prior to any alteration of or addition to the building. 3. Building Board of Review approval of a landscaping plan prior to any alteration of or addition to the building. 4. Use of no more than four service bays. 5. Conformance of signage with the City Sign Regulations and approval of the City Building Inspector. 6. No outside storage of products or materials. 7. Storage of trash and used/unusable tires within the building or within an enclosure which meets the specifications of the City Building Inspector. 8. Conformance with the City Building Code and Fire Safety Regulations. 9 Failure to comply with one or more of the above conditions of approval shall be grounds for revocation of the Conditional Use Permit. The motion was based on the following reasons: 1. Demonstrated need 2. Consistency with Comprehensive Plan 3. Compatibility with surrounding land uses 4. Indication of no negative effects on noise levels, traffic flow, or general health, safety, and welfare of community. MOVED by Mitchell, seconded by Stockman and motion carried unanimously to approve on first reading the ordinance amendment herein quoted by title. 21 � Regular Meeting of the City Council December 21, 1982 *Letter from Bradley Janzen Regarding Withdrawal of Rezoning Petition for 305 Pennsvlvania Avenue South MOVED by Stockman, seconded by Johnson and motion carried unanimously to receive and file the letter from Bradley Janzen, Moriarty & Janzen, P.A., received December 9, 1982, regarding the withdrawal of rezoning petition for 305 Pennsylvania Avenue South and grant their request to cancel the public hearing. *Extension of Plat Approval - Hamman Addition MOVED by Stockman, seconded by Johnson and motion carried unanimously to extend the plat approval of the Hamman Addition to June 1, 1983. 1983 Workers Compensation, Liability and Automotive Insurance John Murphy - Director of Administrative Services - reviewed the different insurance coverages, costs and answered questions from the Council. MOVED by Stockman, seconded by Mitchell and motion carried unanimously to accept the staff recommendation and award the Workers Compensation insurance coverage to F. J. West Agency (North River Insurance). MOVED by Stockman, seconded by Johnson and motion carried unanimously to accept the staff recommendation and award the liability and automotive insurance coverage to BHK&R Agency (Transit Casualty and Granite State Insurance). MOVED by Anderson, seconded by Mitchell and motion carried unanimously to accept the staff recommendation and award the contractor equipment insurance coverage to BHK&R Agency (Home Indemnity) for .30 per $100. *Extension of Plat Filing Deadline for PUD #30-B, Medley Park Townhouses MOVED by Stockman, seconded by Johnson and motion carried unanimously to grant a six month extension of the plat filing deadline for PUD #30-B, Medley Park Townhouses, to July 20, 1983. *Signing of Check Register The Council will sign the final check register in the finance department, December 30, 1982 after 10:00 AM. *No Parking Anytime - Boone Avenue - TH 55 to 7th Avenue North Member Stockman introduced and read the following resolution and moved its adoption: RESOLUTION RESTRICTING PARKING ON BOONE AVENUE The motion for the adoption of the foregoing resolution was seconded by Member Johnson and upon a vote being taken thereon, the following voted in favor thereof: Anderson, Johnson, Mitchell, Stockman and Thorsen, and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted, signed by the Mayor and her signature attested by the Deputy City Clerk. Announcements of Meetings Council Member Anderson and Mayor Thorsen will meet on December 28, 1982 at 8:15 AM in the Mayor/Council Office regarding state aid formulas. Council Member Anderson and Mayor Thorsen will meet on December 29, 1982 at 9:00 AM at the AMM Offices regarding state aid formulas. *Managers Salary for 1983 MOVED by Stockman, seconded by Johnson and motion carried unanimously to approve the Managers salary of $53,000 for 1983. Response to Metropolitan Council Transporation Policy Plan MOVED by Stockman, seconded by Mitchell and motion carried unanimously to add this item to the agenda - Response to Metropolitan Council Transportation Policy Plan. MOVED by Anderson, seconded by Mitchell and motion carried unanimously that the Council express its opposition to the removal of Trunk Highway 55, from Trunk Highway 100 to I-94, from the the Metropolitan Highway System and that this opposition be transmitted to the Metropolitan Council by letter, which will include specific details appropriate to this segment.
