C. 1. On-Sale Wine & Beer License – Nong’s Thai Cuisine, 2520 Hillsboro Avenue North Prepared By Theresa Schyma, City Clerk Summary Nong’s Thai Cuisine, 2520 Hillsboro Avenue North has applied for an On-Sale Wine and Beer License. The restaurant previously had an On-Sale Wine and Beer license, but it was suspended and subsequently revoked in 2015. The suspension was due to failing an alcohol compliance check by selling to an underage individual. The license revocation occurred when a server sold alcohol during the three-day suspension. The restaurant was able to apply for a new license after the appropriate waiting period. In late 2020, the restaurant owner communicated his intention to apply for a new license at a future date since the COVID-19 pandemic had impacted restaurant operations. The City Clerk has reviewed the application materials and has found the documents are in order and complete. The Golden Valley Police Department has completed the background investigation and sees no reason to deny the license. Furthermore, the City Clerk and Assistant Police Chief will be reaching out to the business owner to provide additional alcohol education materials and to keep an open line of communication if the business has any questions about their new license. The new license will be effective through June 30, 2023. After Council approval, the City Clerk will forward the liquor license application to the Minnesota Alcohol Gambling Enforcement Division to complete processing. Financial Or Budget Considerations Fees received for liquor licenses help to defray costs the City incurs to administer license requirements. Licenses are not issued until all fees are received. Gambling License Exemption and Waiver of Notice Requirement – Sons of the American Legion Post 523 Prepared By Theresa Schyma, City Clerk Summary The Sons of the American Legion Post 523 have applied for a Gambling License Exemption to conduct gambling (bingo and raffle) for an event at the Chester Bird American Legion Post 523, 200 Lilac Drive North, on November 18, 2022. As per State Statute organizations that conduct gambling within the City limits have to submit an application for a lawful gambling permit to the State after the permit has been approved or denied by the City. Depending upon the timing of the permit the applicants may request the City to waive the 30- day waiting period. Approve Purchase of One Marked Police F-150 Responder from Guardian Fleet Safety Prepared By Tim Kieffer, Public Works Director Marshall Beugen, Street and Vehicle Maintenance Superintendent Summary Council approved the purchase of two marked Police F-150 Responders on December 21, 2021. The city recently learned one of the vehicles has been cancelled. The city has no way of ordering a replacement because the order banks are closed until next year. The city received a quote from Guardian Fleet Safety, which installs the lights and equipment. Their price is $2,600.24 more than the current state contract. Staff recommends going with the second lowest quote because the lowest quote is no longer available. Additionally, given the current situation and supply chain issues, staff thinks this is a good alternative, rather than waiting until 2023 when pricing will most likely increase. Financial Or Budget Considerations The 2022-2031 Vehicles and Equipment Capital Improvement Program includes $120,000 for the purchase of marked police vehicles in 2022 (V&E-001). Adopt Resolution No. 22-095 Approving the Golden Valley Fire Relief Association By-Law Pension Amount and Terms of Pension Steps. Prepared By Sue Virnig, Finance Director John Crelly, Fire Chief Summary In 2018, staff worked with the Golden Valley Fire Relief Association (GVFRA) to update their policies and by-laws on increases to their yearly pension levels to include the following: •Set their internal policies so that the funding level (assets over liabilities) on their current SC form has to be at least 120%. This means an increase will only be eligible for consideration if assets exceed liabilities by 120% and after an increase is applied to the assets to liabilities ratio cannot be less than 120%. This percentage allows less volatility with the markets and less likely for a municipal contribution (levy) when an increase is approved to the yearly pension. •Change timing to review after the audit is complete instead of December/January. The audit will give actual numbers instead of estimates for the funding level. In 2022, the 2021 audit fieldwork was completed in May. •All requests for increases will be approved by Council before an increase is effective. If the benefit is increased without ratification and a municipal contribution should subsequently become required, the benefit level is no longer effective without ratification and any future benefits can only be paid using the ratified benefit level (the relief association must drop its benefit level to the last ratified level). Staff has had conversations with the GVFRA to discuss the pension increase to $13,000 per year along with changing the steps from a 10–20-year system to a 5-10 years system. The increase would lower the ratio to 122% as of January 1 and met the criteria above. The amount was approved by the GVFRA contingent on the approval of the City Council. G. Adopt Resolution No. 22-096 Approving Easement Agreements with Lockup Self Storage for Olson Memorial Frontage Road on Douglas Drive and Trunk Highway 55 Underpass Project. Prepared By Jeff Oliver, PE, City Engineer R.J. Kakach, PE, Assistant City Engineer Summary As part of the Douglas Drive and Trunk Highway 55 (TH 55) Pedestrian Underpass project, additional easement is required in certain areas to accommodate infrastructure that is needed to properly construct the project. The Lockup Self Storage, at 6250 Olson Memorial Highway, is one of the properties that requires additional easement to physically fit a new trail and retaining wall adjacent to the pedestrian tunnel to the west of the Lockup building. Staff worked with the property owner to order an appraisal of the property. The appraisal was completed in July and staff worked with the property owner to negotiate a reasonable price for temporary and permanent easements. The permanent easement contains 5,105 square feet of Lockup property at a cost of $136,100. The temporary easement contains 1,541 square feet of Lockup property at a cost of $27,600. The temporary easement runs from now until September 30, 2024. If needed, a temporary easement agreement extension would be at $86 per week. The LockUp ownership has agreed to the terms of the agreement and signed the documents, which are being forward to the City Council for approval and signature. Financial Or Budget Considerations Payment in the amount of $163,700 from project funding provided by the Minnesota Department of Transportation through the Local Road Improvement Program as approved by the State Legislature.
